Serenamidori's Commissions Terms of Service

General

• All commissions are for personal use only. You may not claim the work as your own.
• Any commissions may be displayed on external sites as long as there is visible credit of my name (serenamidori) or that it links directly to my commission site (https://serenamidori.art/).
• Commissions may not be used for merchandise, NFTs, or commercial use.
• You are not permitted to use commissioned works in any machine learning or AI capacity, including Stable Diffusion models, Civitai, etc.
• I maintain the right to refuse/cancel a commission at any time. Any reason for doing so will be communicated to you.
• I reserve the right to update the TOS as needed in the future. If any added terms of service apply to your in-progress commission, this will be communicated to you before any other action is taken.

Expectations

• Methods of communication for commission orders are limited to email only, and you understand that any updates or other communications will be made to the email address given when you fill out my commission form.
• Expected time for a commission to be completed will be communicated to you before and during the process.
• During the commission process, you may experience delays due to wait lists or life events. When a delay in your commission occurs, you will receive communication about it.
• Regular work-in-progress updates are not sent by default unless requested before a commission is accepted.
• You may at any time request an update on the progress of your commission, including work-in-progress screenshots.
• Due dates for commissions will only apply if agreed upon before the commission is accepted. You understand that in requesting a specific due date that a fee may be added to your payment total, and no large changes or revisions outside of work-in-progress feedback may be requested in order to meet a deadline. If a deadline is unable to be met for any reason, this will be communicated to you and your fee may be refunded.
• Misconduct and malicious, inappropriate, or rude behavior will not be tolerated during the commission process.

Content Limitations

• Commissions with complex character designs or requests may either incur an additional charge, or be refused. This will be communicated to you before a commission is accepted.
• Commissions may include suggestive content, but will never be NSFW. Genitalia will not be drawn on SFW nude base options for reference character art.
• While some gore, violence, blood, etc. may be drawn in commissions, if your request goes beyond my limits, this will be communicated to you before any commission is accepted.
• The styles that I am offering are as is and no change may be requested in order to decrease my prices.

Payment

• Payment for a commission will be due upfront, and be completed via Paypal Invoice using USD.
• I do not offer payment plans. If you are unable to pay in full for an accepted commission, progress for your commission will be put on hold until paid in full. In most circumstances, your commission may be canceled.
• Any additional charges for a commission will be included in upfront payment.
• Any large changes or additions to a commission in progress will incur an extra charge. In some cases, any changes or additions that would incur this extra charge may be refused instead.

Refund Policy

• Any refund given will not include Paypal service fees. When requesting a refund, you understand that this amount will be deducted from any refund, even when described as a “full refund” below.
• You will not be able to receive a refund for a completed commission.
• If you request a refund and cancel your commission, only a portion of your payment may be refunded to you depending on the amount of progress that was completed. By canceling a commission in progress, you understand you will not receive your full commission payment as a refund.
• If your commission is refused or canceled without your request, OR if you request a refund and your commission has not yet been started, you may receive a full refund.
• If you break my commission TOS, you will not be able to receive a refund.

Paypal Disclaimer

• There will never be a shipping or handling fee as these are digital art commissions, your address should never be needed or requested by me.
• You may not file a charge back for the commission if you have accepted the finished commission. By doing so, you will become blacklisted and displayed in the public in the form of your given contact email and name so other artists may avoid you.
